Default Gearbox fault temperature related

Hi
I have a W220 mid 1999 with the 2.8 engine. It has a gearbox fault which is confusing me a little. From cold all is fine, fault appears after a apprx 20km drive if car is then parked for 15 mins , I guess the temp of the box rises a little when parked. When I pull away it goes into limp mode. Code when read is 109 Rpm sensor n3. If I turn off the ignition & get the car upto speed the cooling effect of the trans cooler seems to lower the temp so that the fault doesn't reappear while I am still moving.
I have bought the electric pack to change in the box as that would appear to account for the fault code. I just need reassurance that the sensor fault is obviously a temperature senstive one & that hopefully that should cure it.
Any comments appreciated.
