Default parking brake engages while driving

ML320 1998
sooooo a couple of times while i've been on the freeway my parking brake has engaged! the first time it happened I pulled on the release but it was already realeased....It felt like it was on because it wouldn't go past a certin speed and the brake light was on and beeping. I had to pull over turn the car off engage the brake and then dis-engage it when i turned it back on. it happened a few days after that time so I took it to the dealer and they ran it and nothing came up then they tested the battery and said it was bad and replaced it......well a couple of weeks later it happened again! and again today!
has anyone ever had this happen???
thanks for your help

p.s. when this happens the speedometer drops to zero and so does the gas gauge [:'(]

nup, not ur parking brake... our ml320 had the same symptoms and it turned out to be the rear brakes locking up. some times the warning beeper would come on at the same time. i think the problem was due to a bolt missing in the brake assembly..
