catalytic converter failure on ML320

My 1999 ML320 sounds like a tank and I took it in to my mechanic and he there is a crack in the catalytic converter on the drivers side. The quote for the repair is over $1400! I just googled it and found that it is covered by the recall. Does anyone know if there is a mileage restriction to be covered under the recall?

my 2000 ML320, 110,000 mi, having the same problem this week (Oct, 2011), found out the weld joint on the catalytic convertor cracked open.
, did some research, as far as I know, there are no mileage or time expiration. Some dealer may say otherwise(as one dealer in Dallas, TX area said that to me today), but that applies only on S & Cl class. Called other dealer, no problem, I am taking in mine for replacement next week.

ML320 cat. converter cracked-stonewalled by MB dealer
I previous post the below. Went to a dealer today. They are not fixing it free, but charged me for diagnostics. did not want to argue. trying to contact EPA.

I had a cracked catalytic converter and had NO luck with the EPA or the regional Mercedes guy! My 1999 ML320 had about 170,000 miles and they said they could do nothing. My VIN was in the recall range. I pointed out that there is no mileage limitation but they would not budge.
My local dealer provided some relief and I had to pay about half of what the repair would have been. I think they provided the part and I paid for labor. It was still an expensive repair.

My mom bought a 1999 ML320 in May this year. She paid less than 10K, but now with all the repairs it's costing so much more.
Right now it sounds like she's trying to take off in a plane whenever she drives it. She took it to a mechanic who said it was the cat converter. I decided to do some research before she paid the $3000 to fix it, and I found this topic, which has helped so much already. I just have a couple more questions..
Is there a time limit on getting this done?
And should I go ahead and call a dealer for information about it?

The other dealer did not help at all, either. I was out of commission for a week or so.
I am planning to contact EPA aggressively next week. But if I get no help, I am taking it to a auto garage and weld it up. My cat was already looked at, and quoted at $250 to weld up the cracked weld joint, or $300 to replace the cat with a after market brand. I am thinking it is better to keep the original one since the cat does not have problems but cracked.
