Default Be aware of Virtual Junkyard

Hi,

Here is my story.

Three months ago, I found the company, Virtual Junkyard in Texas selling used body kit, headlight, taillight... I contacted David Munoz, the sales, and to order a 99 AMG front bumper for E-class. He asked me to send them a check as payment. I thought it is OK, because it is a company at that time....

I sent them the check on 2/5/05, and received a bumper on 2/20/05. But, it is a CLK W208 AMG bumper, NOT for E-class. I contacted David again. He promised me I will get the right bumper "next" week. However, nothing!!! I tried to call him many times, almost everyday after a week. He rarely answers my phone call. When he accidently answers, he always tell me, "let me check out what is going on, and call me 30 minutes later", and hangs up rapidly. Of course, he would not answer my phone again. I also write him email, the same thing, no response. I just keep calling and leaving message...

Now, my money is gone, and I got a CLK bumper occupying space....

My friend told me, I can't do anything with it. First, I can't sue them from California. Second, it is not fraud, because they did send me a bumper, just wrong. I felt so frustrated about it. If anyone knows what I can do, please advice me. Also, if anyone looks for bumper, headlight... whatever, be careful with them.

I found more information about Virtual Junkyard; however, I tried to call the phone number, it is wrong number.

I also checked Better Business Bureaus' website, and found the same phone number with different address.

Update:

Good news! They keep their "promise". Finally, I received the second check of $150 refund after lots of phone call on 10/13/06. (I got the first check of $200 refund in July of 2005.) It is more than 18 months after I sent them the $400 check on 2/5/05. However, I had to agree with the $50 lose. Better than lose $400....

Hello Blue Panda,

My coworker used to have an immaculate, mint condition 1993 Dodge Viper and he ordered some parts online for his Viper, totaling about $7,000 dollars.
The Viper parts company was located near Houston, Texas.
The owner of the company asked my coworker to wire the $7,000 to a bank account to "speed-up" the ordering process. So he complied in good faith.

Well, six months gone by and my coworker never received any of the Viper parts and the owner of the Viper parts company would always answer by saying that his shop was very busy and would return the call later. The owner of the Viper parts company refused to refund the $7,000 dollars.

My coworker and I started to research possible legal options to file a lawsuit against the Viper parts company.

We found out that you CAN sue any company in Texas, as long as you hire an attorney located in the state ofTexas to represent you in a court of law.
The attorney in Texas will file the case on your behalf and 98 percent of the time, you won't even have to appear in the Texas court of law.

My coworker went ahead and hired an attorney in Texas and successfully won the lawsuit againt the Viper parts company.
The Texas court judge awarded my coworker $7,000 dollars plus legal fees.
