It was my wifes car. Yeah, when someone steals your car, repairing it becomes a lesser issue.
The police told us we would never see it again, and the insurance crapped out, sowe ate all the expenses and payoff, and we bought a new 09 Toyota Sienna minivan.
My wife has not even had it 30 days yet, and someone in a construction truck destroyed the entire side, from headlight to taillight while backing. None of thedoors on that side will open now. I suppose 30 days is a good run for a brand new car here.

I can agree with that. Atlanta is a rough not going to lie. I have a cousin who lives in Buckhead. His neighbor is some Rock Star(I think he said someone from Aerosmith) when visiting him last summer the Rock Stars new Lexus was stolen out of his driveway. Unbeleavable in gated community this happined in.

Thank You. The gated community thing only really works if there is an armedguard, on duty, 24/7, verifying ids. We have gates here, but I dont know what good they do, the crooks drive in just as easy as anyone else. I cant believe how many hits we have taken this year, or even in the last three months. If our experience, as reservedas we are, is representative of what the average family is going through in Georgia, this state must be in total chaos.

We have one running vehicle now, and its the twenty year old 190 I bought when I was 23 years old. The 300CE (3000 org miles) was stolen and totalled. The new civic (1200 org miles)was vandalized and totalled in my driveway by punks, The odyssey was atacked by road rage three years ago, now recently stolen. Now the 09 minivan is wiped out and pending. I managed to sell the CLK before anything could happen to it. No deadbeat insurance company has paid for any of these losses, we have cases pending as far back as five years. I have had to basically repair,payoff, sell and replace all of these cars at my own expense so far. Yessuits are filed, maybe ill get some compensatory damages in the next decade.I cant believe this happened to my country; what am I supposed to do buy everyone guns for Christmas? No my wifes job now is to find us another place to live, somewhere peaceful like Beirut maybe.

I have decided that it is going to be more of an "indoor" car. I was driving the 190E to work yesterday and hit a three inch deep ditch the road crew left in theroad; the 190E with its old school fat tiresbounced rightover it, but I was thinking I would have probably bent both front rims in the C300.

That's some incredibly bad luck Silver. When someone hits or damages your vehicle, shouldn't the insurance company pay the damages after the shop sends a bill? I've never been in a documented accident..

Consider yourself very very lucky. You dont want them at all. Lucky for me of all the cars I have owned I have only had 2 accidents. The first one was when my wifes new at the time GMC suv got t boned in the parking lot at a store. It was about 4 months old at the time. The other was I got rear ended in my old 300SD[:@]. It had almost 170k on it, but I loved the car soo much I paid $3,000 to put it back to 100% and ended up selling it a year after that for $4,000.

AMG, To answer your question directly, Yes they should pay. A few issues have slowed the process, probably the biggest issue is my persistence of legally (being made whole). For example, I am simply not going to settle for having the vehicle repaired in a backyard shop on the bad side of town with body filler. The van only has 2800 miles and it WILL be repaired properly with authentic parts. Also there is a (diminished value) issue worth thousands, and (genuine warrantyconcerns) which will have to be addressed. Most people just take the first offer, and are unaware the actual damages recognized by the court system, until they later try to sell or trade the vehiclewith a crash report and abad cavfax, or until they try to get a warranty repair and the warranty company insists a repair was due to the accident not mfg defects, etc. These damageshave to be addressed during the first accident claim, and often they are notcooperative.

Regarding luck, I wished none of this had happened. For whatever reason, fender benders, and thefts have gone rampant here. Almost everyday I see cars getting tagged. Im staying home.
