Default what is up with my car...gear won't go to Drive...

It has to do with my brake, I think....
When I start the car and step on the brake to get gear from P to D, BAS/ESP light come on and I can't get gear to shift from P to anywhere.... I have to press release button to shift the gear [:@]
Is this common problem? Is this something that can be fixed after I change to new brake pad? (I need new brake pad anyway)

Thanks in advance.

Cool shifting from park

I have a 2001 ml 350 and i could not change from Park to anywhere. There is an override on the console you can put a little pin or file in and it holds in the override and allows you to switch gears. It worked for me. Still working after about a year.
