You could have 2 problems, where did you get the brake light switch from,is it new? and 2nd remove the bulb holders from the rear lamps and check for burning/pitting on the holder....the date should be stamped on the new brake light switch,ie 38/09 which is the week it was made and the year..

well i went to my local MB dealer and bought brand new switch. i disconnected the taillamps completely yet i still get the abs/bas/esp and the third light doesnt work... i found a relay by the fusebox across the battery and i replaced it everything started working again... about 2 min. later it went back to same problem... very strange

Did you adjust the brake switch?
I've seen the switch come from the dealer and the "button" is completely depressed into the housing.
Pill the switch out.
Pull the "plunger" all the way to the OUT position.
Push the brake pedal towards the floor.
Install the brake switch.
Release pedal and you should here the plunger ratchet.
Check wires and connectors for breakage.
