Default Transmission problems

I have a 2010 ML350 with 8000 miles and since day one have experienced an issue (problem) with the transmission wanting to stay in 2nd gear. It happens once or twice a week; when starting to accelerate the transmission will stay in 2nd gear almost to the redline. I am not starting rapidly in fact it even happens while starting off going down my street which is a rather steep hill. It is as if I have a manual transmission and left it in 2nd gear. The dealer said they could not replicate problem thus nothing was done. I'd appreciate any feedback as to what may be wrong. Thx

i was hoping i will find a solution for my ML320 THE GEAR JUMPS FROM 1 TO 2 AND, SO WHEN I AM ON A SLOPE, SINCE IT STAYS ON 2 I HAVE TO HOLD THE BREAKS AND ITS AUTO< PLS ANYONE WITH USEFUL INFO SHOULD SPEAK, GREATFUL

722.9 transmissions have a lot of issues. These transmissions "adapt" to your driving style. They have software issues. There are a lot of software updates. They also have internal speed sensor issues. These speed sensors are located in the transmission in the electrical conductor plate. The conductor plate is a part that bolts to the main valve body. Your problem with it staying in second gear sounds like a speed sensor problem.

Default Transmission problems - 722.9 Automatic Transmission

Thank you for your answer. The code of error is 2767 and the soluçao must be to change the valve body that is very expensive. I know that there is a repair kit with the code A000-270-17-00, have you ever heard about it? Could you inform any supplier where could I find that kit? Here in Brazil, the MB said that there aren't availability in the USA and Germany.
