Default CLK430 transmission problem

I wonder if anyone can give me an insight into what could be causing this problem:

I have recently purchased a 1999 CLK430 and I am having some issues with the gearbox. When I accelerate flat out through to say 3rd gear, and remove my foot from the gas, rather than shift into 5th, the car remains high reving and then drops itself into what i presume to be neutral. I lose all drive until i either stop the car or put the box into neutral and back into drive (this doesnt always restore the drive). Also, I have driven the car hard recently and found that on returning to normal driving, the gearbox wouldn't come out of 2nd gear until I stopped the car and switched the engine off.

If anyone can advise I would really appreciate it, thanks.

First steps.
Get the trans oil level checked (dealer job!). Any leaks?
Get the trans fault codes read (anybody with a scanner job)
Basically need to determine wether electronic control or mechanical malfunction.
Lets hope it a sensor or something.
