You can reset the code and drive the car, but the code will come more frequently as the camshaft wears down more. The car will not pass smog. In my case MB apparently agreed (according to the adjuster) to pay half, but $3500 is still too much for a MB with 42000 miles.
This seem to be a common problem for MB on this model, let me know how your complaint turns out. BTW, another "common" problem with this model is a transmission shift plate (repair $1200). How do I know? Don't ask....

I just picked up my 2007 E-350 yesterday from the dealer’s shop. I can now tell that I had lost some “performance” that I had not noticed as the wear was occurring.

I paid $126.00 for a diagnostic test
Original proposed repair cost was $5900.00
Then the dealer agreed to pay for parts which left me with about $4200.00 in labor.
The MB service advisor at the dealership recommended that I call MBUSA and complain. I did this and they are well aware of the problem. There was very little discussion. They take all your information and tell you that a case manager will call you back in 24 hours. About 36 hours later I did get a call back. I was offered a deal where I could pay for all labor or 50% of the total cost. MBUSA said they would give me whichever was in my favor. Since this should be covered under a recall that’s nothing to get excited about, but under the circumstances. I was thankful. When I took the car in for repair I was told my half would be $2950.00. When I was called to pick it up I was given a bill for $2,036.00. Now that was an answer to prayer. I don’t know how they dropped the cost that much, but they did. Thanks LEITH Mercedes in Raleigh, NC!!!

I found there are multiple lawsuits around the US about this problem. At this time federal judge in the state of New Jersey is handling an attempt to lump them all into a class action suit. I found this online, called the judge’s office and got the phone number of the lawyer’s office who is working for the plaintiffs. I called the lawyer’s office and had my name added to their list of names they are collecting.
