Default Mercedes R320 CDI

I am the owner of a 2007 R320 CDI and I love the car. The stylingconversation provokingbut the car handles very well at speed and the seats are extremely comfortable. I completed a trip from Jacksonville Florida to Dallas Texas and I got about 25.1 MPG. Sadly I have had several trips to the dealership. The first time was for surging/bucking between 1500 -2000 rpm which was fixed by replacing the mass airflow sensor. The lastest was the same thing but this time they are saying that a software update for the transmission will correct the problem when it becomes available June 7th 2007. Ireally like the car but all these problems are scaring me and I might have to Lemon Law the total time out of service so far is 9 days and I have only owned the car 2 months. Any ideas or similiar issues?

Proud to report that my R320 CDI is back in my hands and working like a top. Mercedes checked with something called EDAC about the problem and turns out that my crank position sensor and one of the two air filters on the car was clogged.
