ML320 Tranny lock out in park

I can not shift the transmission of My ML320 (2002) from park to drive without pushing the transmission lockout button.
Does any body have an idea about what can be wrong?

First I would check the brake pedal switch. $15 at the dealer and 10 minutes to replace.
