Default ML320 Burning Oil

I doubt my problem is unique but here it goes: 99 ML320 burning oil at a rate of 1Qt every 400 miles or so. Now, I heard that there was a Class Action suit and that MB is suppose to fix the problem with MLs buring oil for free. Can anyone confim or deny that. Also, if MB will not fix it what do I do about it?

Thanks

yes, there is a problem.

the piston, piston ring, and valve seals must be replaced.

Is MB responsible for the fix or is it my responsibility?

yes if the car is still relatively new and under warranty. depending on the dealer.

mercedes-benz germany have already acknowledge this problem which they might tell you stories such as fuel quality problem which reacts on the components, etc.

i myself have done at least 8 engines of this problem.

if you will remove the oil filler cap and see a thick sludge on it...then you got it.

removing the cylinder head cover and looking at the oil separator inside will show you some very strange accumulation.

My 1999 ML320 used a quart every 600 miles. It used oil from new to 80,000 miles said the origional owner.
Now it uses one quart every 4500 miles. (103,000 miles currently)
All I did was 3 things.
1) origional owner used regular gas, thus the timing would be retarted and everything out of sync. I use Shell or Mobil Premium. I use Mobil One Synthetic Oil.
2) I had a carbon /sludge plugged egr tube. I cleaned it out. I cant imagine this was the cause as 1st owner said it used oil since new. The Mercedes service guy wanted $250ish to replace the whole EGR valve. Glad I didnt.
3) Several tanks of gas I used Gumout emmission control cleaner then Marvil mystery oil in the gas.
I submit that some emmission control part could be allowing oil consumption on many of these ML's.

Greetings to All:

There was a class action suit on this matter, which was settled in favor of the plaintiff class. Please see:

Good luck!

Kindest regards,

I have a 2000 ML-320. It ran great from day 1 to about 50,000 miles with no oil burning issue.

Then after 50,000 miles, the engine started burning more oils than normal....about 1 qt per 3000-4000 miles. I used synthetic oil as well as premium gas.

I did get the certficate for my 98 ML320 a few years ago. I've never experienced any related problems, though.
