I do have the brake pedal depressed but it is locked in there and takes a big push to get it out-----works fine once in drive and electronics works to shift to lower gears

I am new to this forum, but here is my 2 cents worth. I had this problem with my 03 S-430 it was stuck in park, luckily it was in my garage. It was caused by a broken plastic piece INSIDE the actual shifter box. There is a detailed post with pictures on how to self repair this problem. dealer wanted $1500 to fix it. The only downside to this is that you can move the shifter out of park, without pressing the brake.

Thank you but I am not mechanically inclined and repair places will not do it for liability reasons

I fixed mine myself. You can replace the plastic piece with a new metal one that wont break again, and cost around $9. If you go to the dealer, they will replace the complete shifter box, complete with old plastic piece inside. The job took me 2 hours, with basic tools.
