05 E320 CDI- kickdowns & acceleration issue

Bought this 05 CDI as a CPO about 400 miles ago. Day of delivery, drove away and car was very sluggish, it wanted to shift through gears quickly w/ no acceleration. Bought it back to dealer, shut car off and waited 10 minutes for tech. Tech came out, started car, and no issues. Car flew like it should. Yesterday, drove on a 100 mile trip, and after stopping in a toll plaza, went to accelerate and same thing. No acceleration. Today, drove 100 mile trip again, had to do a "kick down" to pass a slow car, and the problem resurfaced. Pulled off to side of road, shut engine down, waited 30 seconds, restarted, and car was flying again. Anyone have a similiar issue and how was it resolved. It's going in for service and dio this week. Could use some feedback for dealer.

this may be a dumb question, but where do you get your diesel from?
Also, do you think that not enough fuel may be getting to the engine?

I dont know, I would understand if that happened to a 10 year old car or more that one of the diesel fuel filters would need replacing, but not on an 05? CDI

The problem ended up being a faulty EGR positioner that was covered under the CPO warranty. Car runs fine now. It had nothing to do with the diesel or filters.
